Does GDPR work as it should? Is it reaching the goals for which it was created in the first place?
Some personal data is still available for general public, despite GDPR requirements. At the same time, some institutions are repeatedly covering up the data of public persons: this way, GDPR becomes a tool of abuse.
We believe that the information, such as the names of the spouses, should not be disclosed, if the goal of the regulation can be achieved by other means. On the other hand, be believe that if the information is being collected on the basis of legitimate interest, in addition to the interest of a person not being of a greater importance, it could be disclosed publicly, especially the information on public persons and civil servants.
Together with the experts of Vilnius City Municipality, Office of the Inspector of Journalistic Ethics, and State Data Protection Inspectorate, we discuss the aforementioned questions in the newsportal lrt.lt.

Ar GDPR išties veikia taip, kaip turėtų veikti, ir ar pasiekia tikslus, dėl kurių apskritai buvo sukurtas?
Kai kurie privatūs duomenys, nepaisant GDPR, vis dar yra skelbiami ir prieinami viešai. Tuo tarpu institucijos, nenorėdamos atskleisti informacijos apie viešą asmenį, neretai prisidengia tuo pačiu GDPR, tampančiu piktnaudžiavimo įrankiu.
Laikomės nuomonės, kad, jei reguliavimo tikslą galima pasiekti kitomis priemonėmis, tokia informacija, kaip santuoką sudarančių asmenų vardai, viešinama būti neturėtų. Taip pat manome, kad informacija gali būti skelbiama viešai, jei ji yra renkama remiantis teisėtu interesu, o žmogaus interesas nėra svarbesnis, ypač, turint omenyje viešus asmenis ar valstybės tarnautojus.
